Constitution and Bylaws
ARTICLE 1
Name and Objectives:
Sec. 1 The name of the car club shall be the Rod and Wheelers Club of San Jose
California.
Sec. 2 The club promotes street rodding, safety, camaraderie among the members and other car enthusiasts and is family oriented. The purpose of the club is to support local communities fundraisers and charities. The club is committed to handing down their passion and love for street rodding to future generations.
Article Il
Membership:
Members vehicle(s) must meet NSRA safety requirements and promote safe driving practices, to establish and maintain fellowship and good citizenship in the club and to abide by and be governed by majority rule as established by the Constitution and Bylaws.
Sec. 1. Applicants for membership must be recommended by a member in good standing with the club. Membership requirements include having an interest in street rodding, participating in club activities and abiding by the club Bylaws. Must have and maintain adequate automotive insurance as required by California State law.
Sec 2. Applicants for membership must be accepted by a majority vote of the board of Directors. Once accepted new members must have their vehicles inspected by a NSRA Safety team member.
Sec 3. A prospective member must be present at club events.
Sec 4. A member who's conduct which is otherwise detrimental to the objectives of the club may be suspended or their membership canceled by a vote of 2/3 of the board of directors.
Sec 5. Honorary membership may be conferred upon a person for meritorious service to the club. Honorary members are not allowed to vote or participate in the operation or planning of the club.
ARTICLE III
Initiation Fee and Dues:
Sec 1. The initiation fee for new members shall be $60.00. This will include a hat and plaque.
Sec 2. There is no monthly or annual dues if approved by 2/3 vote of the board of directors.
Article IV
Board Meetings
Sec 1a. Regular meetings will be held every other month.
Sec 1b. Special meetings may be called by the President/Vice President.
Sec 1c. A general membership meeting will be determined by the board.
Sec 2. The order of business for all meetings shall be as specified below:
ARTICLE V
Officers:
Sec 1. The elective officers shall consist of a President, Vice President, Secretary, and Treasurer and approved by a vote of club members. A minimum of 25% membership voter participation required.
Sec 2. The term for all officers shall begin on January 1 and continue for one year.
Sec 3. No candidate shall be eligible for any elective or appointed office unless a full member.
ARTICLE VI
Duties of Officers:
Sec 1. President:
It shall be the duty of the president to preside over all meetings and direct official business. The President shall have the power to appoint such committees as necessary to carry out the activities of the club.
Sec 2. Vice President:
The Vice President shall assist the president in all duties, club functions and preside in the absence of the president.
Sec 3. Secretary:
It is the duty of the secretary to send out notices of meetings and to record and preserve minutes of meetings.
Sec 4. Treasurer:
The treasurer shall be responsible for all financial reports showing income and expenditures for the last period.
Sec 5. Webmaster (Position added - not required in 1952):
Responsible for establishing and maintaining a club website used as an informational resource for club members and for representing the club to those outside of the Rod and Wheelers club.
Sec 6. Safety and Membership:
Maintains a current record of active members, maintains membership application forms and Bylaws signature page for active members. Coordinates all NSRA requirements and safety inspections required for members cars.
Sec 7. Merchandise:
Coordinates the purchase and modification using the club’s logo for all club apparel and other items used to represent the club.
Sec 8. Sergeant at Arms:
The Sergeant at Arms shall maintain quiet and order during meetings. They also shall select persons to help organize and maintain the meeting place as required.
ARTICLE VII
Committees:
Sec 1. The President shall appoint a committee consisting of at least three members to supervise each of the following functions (appointed as needed).
Sec 2. The President may appoint such additional committees as he may determine to be in the interest of the club.
ARTICLE VIII
Amendments:
Sec 1. Proposals to amend the Constitution and Bylaws must be in the form of a written petition signed by at least 2/3 of the board members.
Sec 2. The Bylaws will be reviewed and approved by the board once per year.
Sec 3. An affirmative vote of 2/3 of all ballots cast is necessary for adoption of the amendments to the Constitution and Bylaws.
Sec 4. Amendments so adopted will take effect immediately.
ARTICLE IX
Reading and understanding of Bylaws:
Sec 1. Each member shall be responsible for reading and understanding the Constitution and Bylaws as posted on this website.
Sec 2. Each member must provide a signed copy of the signature page posted on this website.
Sec 3. Each member shall provide a photo(s) of the car(s) designated as a “members” car used to enjoy our hobby and for posting on the club website.
